General Terms and Conditions Driving School Stuurmeester
Article 1 Scope of Application
a) These general terms and conditions apply to the formation and execution of an agreement for services concluded between the student and the driving school owner, unless explicitly agreed otherwise. Taking driving lessons or other services automatically means the student accepts these general terms and conditions.
b) If there is any ambiguity regarding the interpretation of one or more provisions of these general terms and conditions, the interpretation shall be according to the ‘spirit’ of these provisions.
c) If a situation arises between the parties that is not regulated by these general terms and conditions, this situation shall be assessed according to the spirit of these general terms and conditions.
d) An agreement is concluded by signing by the student, or if the student is a minor, by his/her legal representatives, or by taking a product.
Article 2 Definitions
Student: The person who instructs the driving school owner to follow driving lessons and receives driving instruction from the instructor to obtain a driving competency certificate.
Instructor: The person who provides driving instruction to the student to obtain the driving competency certificate.
Driving Instruction: Receiving car driving lessons and instructions from the instructor that the student must follow, necessary to responsibly participate in the CBR practical exam to obtain a driving competency certificate.
Driving School or Driving School Owner: The person who has received an assignment from the student to provide driving instruction and enable an instructor to help the student obtain the driving competency certificate.
Article 3 General
During a driving lesson, the student is not the legal driver of the vehicle but only the actual driver. This means that during a driving lesson, the instructor or, during an exam for obtaining a driving certificate, the examiner, is legally liable.
Traffic violation reports under traffic law are the responsibility of the instructor or examiner. This also applies to the consequences of an accident. A driving lesson also includes taking an examination to obtain a driving competency certificate (driving exam).
Article 4 Obligations Regarding the Driving School
The driving school ensures that:
a) Driving instruction is given by instructors who comply with the provisions of the Driving Instruction Motor Vehicles Act (WRM).
b) The student receives driving instruction from the same instructor as much as possible.
c) A driving course is provided aimed at preparing the student responsibly to participate in the CBR practical exam.
d) After the student has paid the costs of the exam to the driving school, the application for the driving competency exam is actually submitted by the driving school to the Central Office for Motor Vehicle Driver Testing (CBR), within two weeks after the agreed decision with the student that the exam can be requested, provided the student has authorized the driving school at the CBR.
e) The student who has applied for the exam through the driving school has at the date and time appointed by the CBR, the same lesson (motor) vehicle as used during lessons, or an equivalent vehicle, provided that if it is a substantially different type, the student has received at least one lesson in that vehicle.
f) The agreed duration of the driving lesson as per the lesson agreement is fully used for giving driving lessons.
g) Appropriate insurance coverage is in place to cover the driving school’s liability toward the student for damages caused during driving instruction or the exam, consistent with industry standards.
Article 5 Obligations Regarding the Student
The student commits to:
a) Authorize the driving school at the start of the course with their DigiD details via (http://www.mijncbr.nl) to enable booking interim tests/exams. At the same time, the student completes a Health Declaration and pays it directly to the CBR. The student also ensures that this information remains up to date.
b) Verify whether, if the driving exam is passed successfully, a driver’s license can be issued based on his/her residency status. The driving school cannot be held liable if issuance is denied.
c) Report any prohibition on driving motor vehicles. If during the course/exam it appears the student is prohibited from driving, the driving school is not liable for consequences and will not refund lessons or exam fees.
d) Submit a truthful Health Declaration and pay the CBR. The driving school is not liable for the medical fitness outcome. No refund for lessons already taken.
e) Adhere to the agreed date, time, and place for the driving lesson. The school allows a maximum waiting time of 10 minutes, which will be deducted from lesson time. Full lesson fees apply if the student misses the appointment without timely cancellation.
f) Cancel at least 48 hours in advance during office hours (07:00–18:00) by phone or in person; email or app cancellations must also be at least 48 hours prior.
g) Late cancellations will not be charged if for urgent reasons such as a funeral of a close family member (up to 2nd degree) or own emergency hospital admission; illness proven by doctor’s note also exempts payment.
h) Follow all instructions of the driving instructor during lessons.
i) Switch off mobile phones during lessons, going home after lessons or the driving exam. The instructor carries a phone for emergencies.
j) Present valid ID (or equivalent), self-reflection form, and summons card during driving exams or tests. The summons is sent by the CBR via email linked to authorization.
k) Report any medical complaints that might affect driving ability to the driving school or exam bureau before starting instruction or exam. If omitted and the instruction or exam is interrupted or canceled, the driving school is not liable.
l) Keep the lesson car clean: no feet or shoes on upholstery; no eating, drinking, or smoking in the car.
m) Be ready 15 minutes before the lesson start. Each lesson hour requires about 75 minutes. Always carry valid ID during lessons, TTT, and exams.
n) Wear a seatbelt at all times, including as a rear passenger, unless medically exempt with a doctor’s certificate. Refusal to wear a seatbelt results in no instruction and full lesson fees due.
o) Refrain from consuming alcohol or substances that impair driving ability before lessons or exams. If detected, instruction will cease and full fees apply. Damage caused during impaired driving is the student’s responsibility.
p) Continue driving lessons as agreed with the instructor after applying for an exam or interim test until the required lessons are completed.
Article 6 Payment
a) Unless expressly agreed otherwise in writing, lesson fees must be paid in cash against signature on the lesson card. If payment is agreed by bank transfer, it must be made before the lesson. Prepaid lessons are noted on the lesson schedule card.
b) The driving school may increase lesson prices during the agreement. The student may terminate the agreement in writing within two weeks after notification of price increase. Increases in CBR or BNOR fees are passed on and do not entitle termination.
c) If payment is overdue, the student will receive an invoice within 14 days with €15 administration fee added. The school may suspend instruction until payment is settled.
d) If payment is not made within 14 days of invoice date, the student is in default and statutory interest applies.
e) The school may hand over collection to third parties and add collection costs (judicial and extrajudicial) to the debt.
f) If the student purchased a package and stops early, the package price will be recalculated to the price of individual lessons. No refunds are given if the student does not attend an included exam.
Article 7 Theory and Theory Exam
b) The student must have a valid theory certificate when required. Theory exams can be booked at (http://www.mijncbr.nl) and paid via iDEAL to the CBR.
Article 8 Application for Driving Competency Exam (Driving Exam)
a) Unless otherwise agreed in writing, exam application costs must be paid to the driving school by bank transfer after authorization.
b) Within 14 days after payment, the student must email unavailable dates for the TTT or exam; otherwise, a random available date will be set.
c) If the student misses the exam or lacks valid documents, costs for re-application are at the student’s expense.
d) The school may pass on interim price changes of the practical exam after notice and provide written specifications on request.
e) The CBR practical exam is scheduled as close as possible after the training period.
Article 9 Suspension and Cancellation
a) The driving school owner may suspend or dissolve the agreement if the student fails to meet obligations or if delay makes performance under original conditions unreasonable.
b) The school may dissolve the agreement if circumstances make performance impossible or unreasonable.
c) Upon dissolution, claims by the school become immediately due. Suspension preserves legal and contractual claims.
d) The school is not liable for damages or costs caused by suspension or dissolution.
e) If dissolution is attributable to the student, the school may claim damages including direct and indirect costs.
Article 10 Medical Fitness Investigation
If one or more questions on the Health Declaration are answered ‘Yes’, further investigation by the CBR follows. Rental costs of the lesson vehicle for the medical driving test are charged separately. No refund of lessons if the medical certificate is denied by the CBR.
If the Health Declaration is not truthful and the examiner reports this to the CBR doctor during the exam, all consequences and costs are the student’s responsibility.
Article 11 Driving Competency Exam
a) If the CBR or BNOR cancels the exam due to weather, the school may charge for one driving lesson if a lesson was scheduled before the exam.
b) If the student cannot start or complete the exam due to reasons such as family bereavement, vehicle unavailability, or vehicle rejection by examiners, the school will arrange a new exam application free of charge.
c) In these cases, the student receives three free driving lessons for re-examination requests, except for new interim test applications.
Article 12 Privacy Policy
Driving School Stuurmeester processes personal data according to the General Data Protection Regulation (GDPR) effective from May 25, 2018. By entering into the lesson agreement, which includes this privacy policy, the student acknowledges how and why their data is processed and can request deletion if desired.
Article 13 Confidentiality
Driving School Stuurmeester is obliged unconditionally and irrevocably to maintain confidentiality during and after the agreement of all (special) personal data of which it knows or reasonably suspects the confidential nature. All employees with access to personal data are bound by confidentiality and prohibited from unauthorized copying, sharing, or distribution unless legally required.
Article 14 Indemnification
a) The driving school indemnifies the student against claims from third parties arising from collisions during lessons or exams, except if caused by intent or gross negligence by the student or substance use impairing driving.
b) If the student falsely claims no prohibition on driving and takes lessons, the student fully indemnifies the school for fines and financial consequences.
